MingYa Information Technology Co., Ltd. – SyncGo Smart Wi-Fi Digital Calendar
ONE (1) YEAR LIMITED WARRANTY POLICY
Effective Date: July 15, 2024
MingYa Information Technology Co., Ltd. (“MingYa”) extends this Limited Warranty to the original purchaser (“You” or “Your”) of the SyncGo Smart Wi-Fi Digital Calendar (“Product”) against defects in materials and workmanship under normal use for a period of ONE (1) YEAR from the date of original retail purchase.
1. What This Warranty Covers: This Limited Warranty covers defects in materials and workmanship of the Product when used in accordance with MingYa’s official documentation (e.g., user manuals, quick start guides). If a defect arises during the Warranty Period, and You follow the instructions for returning the Product, MingYa will, at its option, either: (a) repair the Product using new or refurbished parts; (b) replace the Product with a new or refurbished Product that is equivalent to the Product being replaced; or (c) refund the original purchase price of the Product.
2. What This Warranty Does NOT Cover: This Limited Warranty does NOT cover: (a) Damage caused by misuse, abuse, accident, modification, improper installation, acts of God (such as lightning, floods, or natural disasters), or external causes. (b) Damage caused by service performed by anyone who is not an authorized service provider of MingYa. (c) Damage caused by operating the Product outside the permitted or intended uses described by MingYa. (d) Consumable parts, such as batteries, unless damage occurred due to a defect in materials or workmanship of the Product itself. (e) Cosmetic damage, including but not limited to scratches, dents, and broken plastic on ports, unless failure has occurred due to a defect in materials or workmanship. (f) Products with a defaced, modified, or removed serial number. (g) Loss of data, as MingYa is not responsible for any data loss that may occur. You are solely responsible for backing up any data stored on Your Product. (h) Any third-party software or accessories, even if packaged or sold with the Product. (i) Any costs associated with the installation, removal, or reinstallation of the Product. (j) Products purchased from unauthorized resellers.
3. Who Is Covered: This Limited Warranty extends only to the original retail purchaser of the Product and is not transferable.
4. How to Obtain Warranty Service: To obtain warranty service, You must contact MingYa’s customer support within the Warranty Period. You may be required to: (a) Provide proof of original retail purchase (e.g., sales receipt or invoice) that shows the date of purchase. (b) Provide the serial number of the Product. (c) Describe the defect in detail. (d) Follow MingYa’s instructions for returning the Product. You may be responsible for shipping and handling costs for returning the Product to MingYa.
MingYa reserves the right to verify the validity of Your warranty claim.
5. Exclusion of Other Warranties: EXCEPT AS STATED IN THIS LIMITED WARRANTY, MINGYA INFORMATION TECHNOLOGY CO., LTD. DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY MINGYA OR A MINGYA AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY.
6. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MINGYA INFORMATION TECHNOLOGY CO., LTD. BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF MINGYA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MINGYA’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THIS WARRANTY OR THE PRODUCT SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE PAID BY YOU FOR THE PRODUCT.
7. Governing Law and Jurisdiction: This Limited Warranty shall be governed by the laws of The People’s Republic of China, without regard to its conflict of laws principles. Any disputes arising from or in connection with this warranty shall be subject to the exclusive jurisdiction of the courts located in Zhuhai, China.
8. Your Rights Under State/National Law: This Limited Warranty gives You specific legal rights, and You may also have other rights which vary from state to state or country to country. Some jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to You.
